- LEADING
1.1 These are the General Terms and Conditions of Laguna Treasures, which apply to all orders placed via the web shop on www.lagunatreasures.com (hereinafter: “Webshop”). Read these Terms and Conditions carefully.
1.2 By placing an order, you agree to these General Terms and Conditions. If one or more provisions of these General Terms and Conditions turn out to be invalid or declared invalid, the rest of the provisions of these General Terms and Conditions will remain in full force. The void or invalid provision(s) will be replaced by Laguna Treasures, taking into account the purpose and intent of the original provision(s), as far as possible.
- OFFER
2.1 The offer on www.lagunatreasures.com is without obligation and valid while stocks last.
2.2 Offers do not automatically apply to future orders.
2.3 Any errors or inaccuracies in the information on www.lagunatreasures.com cannot bind Laguna Treasures.
- ORDERS
3.1 Once an order is placed, Laguna Treasures sends an email to confirm the details of the order and the total cost associated with the order.
3.2 An agreement is only concluded when the total costs associated with the order have been paid.
3.3 Laguna Treasures is entitled to refuse an order or to attach special conditions to an order.
4. PRICE AND PAYMENT
4.1 All prices stated on www.lagunatreasures.com are in euros and include VAT (21%).
4.2 Shipping costs and any import duties are not borne by Laguna Treasures and are not included in the prices listed on www.lagunatreasures.com.
4.3 Shipping costs are clearly stated before the order can be confirmed.
- DELIVERY
5.1 Shipping of an order takes place as soon as Laguna Treasures has received payment for the order, to the specified address.
5.2 Laguna Treasures strives to ship orders within 3 working days of receipt of payment.
5.3 If Laguna Treasures is unable to ship the order within 30 days after placing the order, the order can be canceled free of charge.
5.4 Laguna Treasures will send an email with information about the shipment status of the order.
5.5 Any import duties, customs formalities and taxes related to the order are not borne by Laguna Treasures.
5.6 Ownership of the items that are part of the order and the related risk is no longer for Laguna Treasures from the time the order is received.
- RETURNS
6.1 Orders can be canceled for no reason within 14 days from the date of delivery.
6.2 This right to cancel is included in the order.
6.3 All items must be returned in their original packaging and with the original tags.
6.4 Returned items that have been washed, worn, stained, damaged or altered in any way will not be accepted by Laguna Treasures. These items will be returned to the sender. The costs for these items will be refunded, minus the costs for returning the items.
6.5 Returns must be sent to the following address, with the name and address of the sender:

6.6 Laguna Treasures strives to process returns within 5 working days of receipt. The cost of the returned items will be refunded to the same credit card or account that the order was paid for. Shipping costs are non-refundable.
6.7 Laguna Treasures advises returning returns in a traceable manner. Lost packages will not be refunded.
6.8 If Laguna Treasures has accidentally shipped the wrong item or an item is found to be damaged upon receipt, Laguna Treasures must be notified as soon as possible and no later than 14 days after receipt of the item by sending an email. to aloha@lagunatreasures.com. In that case, Laguna Treasures will refund the shipping costs for the return and ship the correct item as soon as possible. If the item is not available, Laguna Treasures will also refund the cost of the item.
- RIGHT OF WITHDRAWAL
7.1 Complete orders or items that are part of an order can be revoked without giving reasons within 14 days of receipt of the order.
7.2 In the event of a withdrawal, Laguna Treasures must be informed of the withdrawal by email and the affected items must be returned within 14 days of order delivery.
7.3 Shipping costs of the returned items are not borne by Laguna Treasures.

8.2 Laguna Treasures tries to respond to emails within three days.

9.1 The content on www.lagunatreasures.com has been compiled with the greatest care. Nevertheless, Laguna Treasures cannot guarantee that the information on www.lagunatreasures.com is correct.
9.2 Laguna Treasures is not liable for the consequences of incorrect information on www.lagunatreasures.com such as errors or mistakes.
9.3 Laguna Treasures is not liable for damage in the event of the temporary inaccessibility of www.lagunatreasures.com.

- PRIVACY
10.1 Laguna Treasures will treat personal data with the utmost care.
10.2 Laguna Treasures will not share personal information with third parties, unless that information is necessary for the delivery of the order.
10.3 To place an order, Laguna Treasures needs a name, billing address, delivery address and payment details. The payment details will only be used for the payment process.
10.4 Statistics of website visits are kept for internal purposes. Information about the number of visitors and the frequency of website visits will be used for internal research and improvement.
- LIABILITY
11.1 All items at Laguna Treasures are produced with the greatest care.
11.2 The colors of the items as shown on www.lagunatreasures.com may differ from the actual colors of the items. Laguna Treasures is not liable for such color differences.
11.3 Laguna Treasures is not liable for any accident involving or caused by or damage caused to items ordered on Laguna Treasures as a result of, for example, improper use such as use that is not in accordance with the instructions.
11.4 Laguna Treasures cannot be held liable for any indirect or consequential loss, including but not limited to the loss of information, profit, turnover or reserves.
11.5 In case Laguna Treasures is liable for any damage, the liability of Laguna Treasures is limited to the amount that Laguna Treasures receives from the insurance. In the event that the damage is not covered by insurance or Laguna Treasures does not have insurance for such damage, the liability of Laguna Treasures is limited to the total cost of the order.
11.6 The limitation of liability as included in these General Terms and Conditions does not apply in case of damage caused by intent or deliberate recklessness on the part of Laguna Treasures.
- FORCE MAJEURE
12.1 In case of force majeure, Laguna Treasures is entitled, at its option, to cancel the order without legal intervention, by giving written notice thereof. Laguna Treasures cannot be held liable for any damage, unless this would be unacceptable given the circumstances by standards of reasonableness and fairness.

13.1 All information on www.lagunatreasures.com is copyrighted. It is not permitted to copy, use or distribute any information, photo or content of www.lagunatreasures.com in whole or in part without the prior written permission of Laguna Treasures.
- APPLICABLE LAW AND COMPETENT COURT
14.1 All rights, obligations, offers, orders and agreements to which these General Terms and Conditions apply are exclusively governed by Dutch law.
14.2 All disputes related to these General Terms and Conditions will be submitted to the competent court of the Rotterdam District Court.
